Il legato in conto di legittima

The work aims to demonstrate that the legacy established in favor of the legitimary, which is not a substitute for the legitimate share, poses two distinct problems, depending on whether, with regard to the beneficiary, we consider his position as an heir (and therefore the hereditary share) or his position as a legitimate (and, therefore, at his legitimate share). With respect to the position of a legitimate person, it is necessary to investigate whether the “legato in conto di legitima” is disposed of with imputation or with the burden of imputation, in order to establish whether the legitimary is injured or not. With reference to the position of heir, it is necessary to verify on which heirs weighs the legate. With the understanding that the two assessments can certainly be combined with each other, generating, essentially, six distinct possibilities.

Il lavoro intende dimostrare che nella valutazione del legato disposto a favore del legittimario, che non sia sostitutivo della legittima, si debbono considerare due distinte questioni, a seconda che, rispetto al beneficiario, si abbia riguardo alla sua posizione di erede (e, dunque, alla quota ereditaria) oppure alla sua posizione di legittimario (e, dunque, alla sua quota di legittima).Rispetto alla posizione di legittimario occorre indagare se il legato in conto di legittima sia disposto con dispensa da imputazione o con onere di imputazione, al fine di stabilire se il legittimario risulti leso oppure no. Con riferimento alla posizione di erede, occorre verificare su quali eredi gravi il legato. Con intesa che le due valutazioni possono certamente combinarsi tra loro, dando, sostanzialmente, luogo a sei distinte possibilità.
