Subsidiary cooperation. A new type of relationship between public and private bodies supported by the EU law

The paper investigates the possibility to track the relationships of subsidiarity going to look into European experiences in which all member states are actively promoting private entities supported by the EU. On the basis of this perspective he deems state aid rules and regulations to protect the environment some useful experiences for the purpose. In particular, these relations facing models of cooperation between public authorities and private companies, which would constitute a point of significant interest given that it is a model that clearly differs from that of competition that the EU favors. The essay then explains the distinction between models of cooperation and competition models and tracks the fundamentals of their coexistence in Europe.

Il saggio indaga la possibilità di rintracciare le relazioni di sussidiarietà nell'ordinamento europeo andando a ricercare tutte le esperienze nelle quali gli stati membri favoriscono attivamente soggetti privati sostenuti dall'UE. Sulla base di questa prospettiva rintraccia nella disciplina degli aiuti di stato e in alcune normative a tutela dell'ambiente esperienze utili a tal fine. In particolare, queste relazioni prospettano modelli di relazione di cooperazione tra autorità pubbliche e imprese private, la qual cosa costituisce un punto di significativo interesse tenuto conto che si tratta di un modello palesemente diverso da quello di concorrenza che l'UE favorisce. Il saggio quindi spiega la distinzione tra modelli di cooperazione e modelli di concorrenza e rintraccia i fondamenti della loro convivenza in Europa.
