The article examines the nature of constitutional "chose jugée" as it i disciplined in the Italian Constitution and as established in the Court decisions. The author criticizes the violation of rulings by the constitutional court by the legislator, trying to reinforce a disposition which was already declared void by the Court. The matter disciplined, the limits to concentration of property of media companies in the tv market makes even more evident the illegitimate violation of the Court case law.
