In this paper, the author investigates the testamentary disposition «ex re certa», verifying when it attributes to the beneficiary the status of heir. The Author then investigates the fate of the inheritance, when the assets existing at the time of the packaging of the will are larger or smaller than those existing at the time of the opening of the succession. Investigates, therefore, the relationship between the institution of heir «ex re certa» and the division of inheritance made by the testator.
