Funzione di emergenza e modelli amministrativi alla prova dello stress test degli eventi sismici nell'Italia centrale

The process of 'normalisation' of the management of emergencies carried out in Italy is challenged following the occurrence of disastrous events, when the need to face serious calamities induces the legislator to prepare ad hoc measures of an administrative nature which end up overlapping with the ordinary responsibilities outlined by the legislator. This paper, drawing on a specific event - that of the series of earthquakes that shook central Italy between 2016 and 2017 - verifies the reaction of public authorities in concrete terms, highlighting the overlapping between two models of administration that reflect a different acceptation of the function of emergency management. The author believes that this overlapping, defined on the basis of a supposed and clear distinction between the functions of aid and reconstruction, presents a range of problems, both in terms of legitimisation and in terms of efficacy of public action. And yet this condition does not provoke a real conflict between powers, to the point of supposing that the reaction thus defined is in actual fact the upshot of an 'agreement between bureaucracies'.

Il processo di "normalizzazione" della gestione delle emergenze perseguito in Italia è sfidato all'occorrenza di eventi calamitosi, quando la necessità di fronteggiare gravi calamità induce il legislatore ad approntare misure ad hoc di natura amministrativa che finiscono per sovrapporsi con le ordinarie responsabilità delineate dal legislatore. Questo scritto, prendendo spunto da un evento specifico, quello della scia sismica che sconvolto l'Italia centrale tra il 2016 e il 2017, verifica nel concreto la reazione dei poteri pubblici, mettendo in evidenza la sovrapposizione tra due modelli di amministrazione che riflettono un'accezione diversa della funzione dell'emergenza. L'a. ritiene che questa sovrapposizione, definita in base a una supposta e chiara distinzione tra le funzioni di soccorso e le funzioni di ricostruzione, profila numerosi problemi sia in termini di legittimazione sia in termini di efficacia dell'azione pubblica. Eppure, questa condizione non provoca un reale conflitto tra poteri, tanto da supporre che la reazione così definita sia in realtà il frutto di un "concordato delle burocrazie".
