Terrorismo, diritto alla sicurezza e diritti di libertà. Una riflessione intorno al decreto legge n. 7 del 2015

The terrorist attack to the satirical magazine Charlie Hebdo, which took place in the heart of Europe and in the centre of Western culture, has caused a worsening of the safety emergency. The Italian government has responded by the issuing of a decree-law ( n. 7 /2015, on anti-terrorism measures) that confirms, balancing between security and freedom, the tendency to lean towards the restriction of the latter. The article, after developing a brief introduction about the right to security and the corresponding legislative choices, focuses on the innovations introduced by this decree-law and on the possible conflicts with some constitutional principles.

L'attentato terroristico alla redazione del giornale satirico Charlie Hebdo, avvenuto nel cuore dell'Europa e della civiltà occidentale, ha causato un acuirsi dell'emergenza sicurezza. A questo, il governo italiano ha risposto con l'emanazione di un decreto legge ( d.l. n.7 del 2015, recante misure antiterrorismo) che conferma la tendenza a propendere, nel bilanciamento fra diritto alla sicurezza e diritti di libertà, verso la restrizione di questi ultimi. L'articolo, dopo aver svolto una breve premessa in merito al diritto alla sicurezza e alle scelte del legislatore penale in questo campo, si sofferma sulle novità introdotte con tale decreto e su possibili contrasti con alcuni principi costituzionali.
