Di alcuni fraintendimenti intorno alla maternità surrogata. Il giudice soggetto alla legge e l’interpretazione para-costituzionale

The essay highlights how, in the light of some misunderstandings and on the basis of the simplistic distinction between altruistic and commercial surrogacy, there is an attempt to undermine the legal prohibition of commercial intermediation with regard to surrogate motherhood by means of creative jurisprudence. In this way, however, as it emerges from a recent ruling by the Constitutional Court, there is the risk of promoting a reductive conception of the interests of children born through a surrogacy arrangement and of the related constitutional principle mater semper certa est. Furthermore, the Author criticizes the argument according to which the regulation of such practice would be the appropriate instrument to stop the so called procreative tourism.

Il saggio evidenzia come, in ragione di alcuni fraintendimenti e sulla base della semplicistica distinzione tra maternità surrogata altruistica e commerciale, vi sia il tentativo di svuotare di significato, per via giurisdizionale, il divieto legislativo di intermediazione commerciale in materia di maternità surrogata. In questo modo, tuttavia, come emerge da una recente sentenza della Corte costituzionale, vi è il rischio di promuovere una concezione riduttiva degli interessi dei minori nati da surrogazione di maternità e del connesso principio di rilievo costituzionale mater semper certa est. È sottoposta, inoltre, a critica la tesi secondo cui la regolamentazione di tale pratica sarebbe lo strumento idoneo ad arrestare il c.d. turismo procreativo.
