“Risocializzare l’Europa”. La dimensione sociale europea tra economia di mercato e integrazione sovranazionale

The article deals with the struggle for a European social dimension. It analyses, in a historical perspective, how social rights are guaranteed in the European Union, taking into consideration the interaction between national and supranational level. More specifically, it examines the ECJ’s case law on that issue, focusing the attention on the juridical relevance of the Charter of Fundamental Rights of the European Union. Then, the article considers recent attempts to take the necessary steps to incorporate the substance of the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union into the legal framework of the European Union (art. 16 TSCG), the introduction of a Convergence and Competitiveness Instrument and the meaning of the European Pillar of Social Rights. In conclusion, the article investigates the role of the Member State in the new European context, trying to underline how important is the European Union for its existence in the light of the “Rodrik’s trilemma”.

Il lavoro affronta il temadella dimensione sociale europea, analizzando, in una prospettiva storica, le modalità con cui nel tempo i diritti sociali hanno trovato spazio e protezione, in particolare attraverso l’esame della giurisprudenza della Corte di Giustizia e l’uso che si è fatto della Carta dei diritti fondamentali dell’Unione europea in tale ambito. L’articolo si sofferma quindi sui recenti documenti delle istituzioni europee che mirano ad inserire nell’ordinamento europeo i principi del Trattato sulla stabilità, il coordinamento e la governancenell’Unione economica e monetaria (art. 16 TSCG), sul processo volto a determinare uno strumento di convergenza in materia sociale e sul significato del Pilastro europeo dei diritti sociali. Nelle conclusioni, attraverso l’analisi del ruolo che lo stato membro può svolgere nel contesto europeo, si cerca infine di sottolineare la centralità dell’Unione europea per l’esistenza stessa della statualità alla luce del Trilemma di Rodrik.
