On 15 December 2016, the Grand Chamber of the European Court of Human Rights (ECtHR) issued its judgement on the case Khlaifia and others v. Italy, concerning the alleged violation of the prohibition of collective expulsion of aliens under Art. 4 of the Fourth Protocol to the European Convention on Human Rights (ECRH). In particular, the applicants claimed that Italian authorities had acted inconsistently with the prohibition in repatriating them without any individual assessment. According to a strict interpretation of Art. 4 of the Fourth Protocol, the Grand Chamber found no violation of the prohibition of collective expulsions of aliens. That provision being the only one of the ECHR offering some procedural safeguards against the discretional expulsion of irregular migrants, the author contributes to assess the appropriateness of the aforementioned strict interpretation. The author also compares Art. 4 of the Fourth Protocol, as interpreted in the Khlaifia judgment, and the notion of collective expulsions pursuant to the Draft Articles on Expulsion of Aliens adopted by the United Nations International Law Commission in 2014, which the Grand Chamber referred to.
Il contributo valuta l'adeguatezza dell'interpretazione restrittiva dell'art. 4 del Protocollo n. 4 alla Convenzione europea dei diritti dell'uomo (CEDU), accolta dalla Grande Camera della Corte europea dei diritti umani nella sentenza del 15 dicembre 2016 sul caso Khlaifia, alla luce della precedente giurisprudenza della Corte nonché della nozione di espulsioni collettive di stranieri contenuta nel Progetto di articoli sull'espulsione di stranieri adottato dalla Commissione delle Nazioni Unite sul diritto internazionale nel 2014, a cui pure si è riferita la Grande Camera nella sentenza in esame.
