The panorama of dispute resolution has changed profoundly in recent years. Next to the job and arbitration, traditional settlement of the dispute based on the decision by the court or arbitrator techniques, it is indeed facing a new protagonist, mediation instead focuses on assistance of third parties. The theory of mediation is an expression of our times and reflects, from an ideological point of view, the deep aspirations of the post-modern society: alongside the idea of access to justice is the need of participation and self-realization of the person, who joins the phenomenon of the decline of the rule of law and the welfare state crisis. Despite the ancient roots, modern mediation was born in the United States around the 70s but it quickly spread with inevitable changes and adaptations in the world, and is now present - with what we consider one of the most successful legal transplant ever performed - in almost all legal systems. Italy, like the rest of Europe, has not remained alien to the wave of diffusion of alternative methods of dispute resolution (ADR). The role of mediation made by the Italian legislature (D.lgs. n. 28/2010), while placing in the wake of the US model and its models of other jurisdictions, has elements of originality. The book aims to provide a careful analysis of the evolution of the discipline of mediation and conciliation in civil and commercial matters both within the EU and in the panorama of the most relevant comparative experiences, first of all Italian, analyzing, in particular, the differences that exist between the alternative means of dispute in Anglo-Saxon countries and those of continental Europe and who find a basis in the different cultural and legal approach between the common law and civil law systems Romanist. Ahead of such complex situations, indeed, the comparative analysis of different resolution tools which have similar functions is essential and is of great use. With the look of comparatist, then, we have tried to indicate similarities and differences between the legal instruments that the various instances, institutional or otherwise, claimed, through an assessment of the different legal, national and international. We know well (and better than anyone we know we lawyers) that the legal instruments are precisely only instruments, does not in itself decisive, and that is crucial for their effectiveness are the circumstances and methods of use. We know, however, just as well that the timely and proper preparation of legal instruments has been and is, in our civilization, which is essential for the correct definition and just solution of the issues that arise in human relationships. The work is divided into four chapters whose lowest common denominator is represented by the objective of helping to encourage a cultural change, a change of mentality that allows to deal with conflicts in a different perspective and with a view that "what is needed rule is not change, but change cultures". The first chapter is devoted to the analysis of the political and Community legal development of ADR instruments in civil and commercial context for consumer protection, then followed by two chapters that specifically deal with the specific identity of the individual experiences of civil law (Italy, France , Germany, Belgium, Holland, Spain, Portugal, Brazil) and common law (England, USA, Australia, Florida), highlighting, in fact, the convergences and divergences. The last chapter, finally, is, therefore, addressed the history and evolution of the Eastern model of dispute resolution with a particular focus Commercial Arbitration in China and on mediation in Taiwan.
Il panorama della risoluzione delle liti è negli ultimi anni profondamente mutato. Accanto al processo e all’arbitrato, tradizionali tecniche di soluzione della controversia basate sulla decisione da parte del giudice ovvero dell’arbitro, si è infatti affacciata una nuova protagonista, la mediazione, imperniata invece sull’assistenza del terzo alle parti. La teoria della mediazione è espressione del nostro tempo e rispecchia, dal punto di vista ideologico, istanze profonde delle società post-moderne: accanto all’idea dell’accesso alla giustizia vi è l’esigenza di partecipazione e autorealizzazione della persona, che si unisce al fenomeno del declino del primato della legge e alla crisi dello stato sociale. Nonostante le antiche radici, la moderna mediazione è nata negli Stati Uniti intorno agli anni ‘70 ma si è presto diffusa con inevitabili variazioni ed adattamenti, nel mondo, ed è oggi presente – con quello che possiamo considerare uno dei più riusciti legal transplant mai effettuati – nella quasi totalità degli ordinamenti giuridici. L’Italia, come il resto d’Europa, non è rimasta estranea all’ondata di diffusione dei metodi alternativi di soluzione delle controversie (c.d. ADR). La figura della mediazione costruita dal legislatore italiano (D.lgs. n. 28/2010), pur ponendosi sulla scia del modello statunitense e dei modelli propri di altri ordinamenti, presenta elementi di originalità. Il volume intende fornire un’analisi attenta dell’evoluzione della disciplina della mediazione e conciliazione in ambito civile e commerciale sia all’interno dell’Unione europea sia nel panorama delle più rilevanti esperienze comparatistiche, prima fra tutte quella italiana, analizzando, in particolare, le differenze che sussistono tra gli strumenti alternativi delle controversie nei Paesi anglosassoni e quelli dell’Europa continentale e che trovano un fondamento nel diverso approccio culturale e giuridico tra i sistemi di common law ed i sistemi romanistici di civil law. Davanti a situazioni così complesse, invero, l’analisi comparatistica dei diversi strumenti di risoluzione che hanno simili funzioni si impone ed è di grande utilità. Con lo sguardo del comparatista, dunque, si è cercato di indicare tra convergenze e divergenze gli strumenti giuridici che le varie istanze, istituzionali e non, reclamavano, attraverso una valutazione delle diverse esperienze giuridiche, nazionali ed internazionali. Sappiamo bene (e meglio di chiunque altro lo sappiamo noi giuristi) che gli strumenti giuridici sono per l’appunto soltanto strumenti, di per sé non risolutivi, e che fondamentali per la loro efficacia sono circostanze e modalità del loro impiego. Sappiamo, però, altrettanto bene che l’elaborazione puntuale e corretta di strumenti giuridici è stata ed è, nella nostra civiltà, indispensabile per la corretta definizione e giusta soluzione delle questioni che si pongono nei rapporti umani. L’opera si articola in quattro capitoli il cui minimo comun denominatore è rappresentato dall’obiettivo di contribuire a sollecitare una trasformazione culturale, un cambio di mentalità che consenta di affrontare i conflitti in un’altra prospettiva e nell’ottica che “what is needed is not rule change, but culture change”. Il primo capitolo è dedicato all’analisi della evoluzione politico-giuridica comunitaria degli strumenti di ADR in ambito civile e commerciale a tutela del consumatore, seguono poi due capitoli che specificamente si occupano delle peculiarità che caratterizzano le singole esperienze di civil law (Italia, Francia, Germania, Belgio, Olanda, Spagna, Portogallo, Brasile) e common law (Inghilterra, Usa, Australia, Florida), evidenziandone, appunto, le convergenze e le divergenze. L’ultimo capitolo, infine, è, quindi, rivolto alla storia e all’evoluzione del modello orientale di risoluzione delle controversie con un focus particolare sull’arbitrato commerciale in Cina e sulla mediazione a Taiwan.
