This article analyzes the issue concerning the split jurisdiction between administrative and ordinary courts over disputes regarding the right to obtain incentives for plants powered by renewable energy and assimilated sources, with particular reference to the so-called “certificate market”, which are distinguished in white and green certificates. Moreover, this work examines the issue concerning the disputes about general administrative acts, with particular reference to the resolutions issued by the Italian Regulatory Authority for Electricity, Gas and Water (i.e. the independent body which regulates, controls and monitors the electricity and gas markets in Italy), as well as the administrative acts and guidelines issued by the Gestore Servizi Elettrici (i.e. the state-owned company which promotes and supports renewable energy sources in Italy).
Il contributo analizza il problema del riparto di giurisdizione in materia di diritto alle incentivazioni a favore degli impianti alimentati da fonti di energia rinnovabile o assimilate, riguardo il c.d. mercato dei certificati, distinti, come è noto, in certificati bianchi e verdi. E' stato inoltre affrontato anche il problema del contenzioso relativo agli atti amministrativi generali, con particolare riferimento sia alle delibere dell'Autorità per l'energia elettrica il gas e il sistema idrico in questo settore, sia ai provvedimenti e linee guida del Gestore dei servizi elettrici.
