The author examines how the Italian legal science during the ‘Restoration’ period, which in previous times suffered from a real "historiographical prejudice" that wanted it almost exclusively linked to the French world, can now be finally understood as broadly influenced by the German ‘Historical’ School and by its greatest representative, Friedrich Carl Von Savigny. From archival researches, which have converged in many other publications, the author shows how profound and important the contribution of the of the German jurist has been on the legal panorama in the Italian pre-unitarian States, and, above all, on the major theories of the Italian legal doctrine of the early nineteenth century.
L’autore indaga come la scienza giuridica italiana della Restaurazione, in un primo momento vittima di un vero e proprio “pregiudizio storiografico” che la vuole legata quasi esclusivamente al mondo francese, abbia invece assorbito grandemente l’influenza della Scuola storica tedesca e del suo massimo esponente, Friedrich Carl Von Savigny. Dalle ricerche d’archivio, confluite in molteplici altre pubblicazioni, l’autore dimostra come sia stata profonda ed importante l’influenza del giurista tedesco sul panorama giuridico degli Stati italiani preunitari, e soprattutto sul pensiero dei più eminenti giuristi italiani del primo ottocento.
