Il fondamento costituzionale implicito e la mancata sistematizzazione del Segreto di Stato in Grecia: l’eredità del passato e le resistenze attuali.

In the Republic of Greece there is no unitary legislation concerning thestate secret. The latter not only does not correspond to a specific legal category, but, as prerogative of the executive, it is not even mentioned in the Constitution of 1975. However, it is possible to identify an implicit constitutional basis and track down a number of provisions potentially related to the State Secret. In this paper, the author offers a framework whose composition was made possible during the months spent in Athens in the A.Y.2011-2012 where she led a research project entitled "Constitution and State Security in Greece: How to protect democracy in a changing world" as part of the Research fellowship of which she was awarded by the Alexander S. Onassis Public Benefit Foundation under the supervision of Prof. Kostas Mavrias.

Nell’ordinamento della Repubblica di Grecia non esiste una normativa organica ed unitaria sul segreto di Stato. Quest’ultimo non solo non corrisponde ad una categoria giuridica specifica, ma, in quanto prerogativa dell’Esecutivo, non trova nemmeno accoglimento nella Costituzione del 1975. Tuttavia, è possibile dedurne un fondamento costituzionale implicito e rintracciare una pluralità di disposizioni potenzialmente riferibili al tema del segreto di Stato. In questo lavoro l'autore si propone di offrire un quadro di sintesi la cui composizione è stata resa possibile nel corso dei mesi trascorsi ad Atene nell’a.a. 2011-2012 dove ha condotto un progetto di ricerca dal titolo “Constitution and State Security in Greece: How to protect democracy in a changing world” nell’ambito della Research fellowship di cui e' stata insignita dalla Alexander S. Onassis Public Benefit Foundation sotto la supervisione del Prof. Kostas Mavrias.
