This article analyses the case of the so-called “mandatory divorce” as a consequence of the legal rectification of sex, regulated by the Statute n. 164/1982. The Italian Supreme Court (Corte di Cassazione) recently asked to the Constitutional Court to decide whether the said Statute is in conformity with the Constitution. After a description of the facts of the case and of the historical background, this article reconstructs the different constitutional conceptions of the family that have been occurred over time and the meaning of the so-called “heterosexual paradigm”. The article refers then to the German experience, and analyses the case-law of the European Court of Human Rights concerning transsexuals. Finally, the article examines the case-law of the Italian Constitutional Court on marriage in order to consider whether general principles could be identified as regards the topic discussed. L'articolo analizza, sotto un profilo costituzionale, la situazione legislativa che prevede lo scioglimento del matrimonio con effetti ex nunc nel caso in cui uno dei due coniugi cambi legalmente sesso. Il lavoro si sviluppa dando conto della concezione della famiglia e della sua evoluzione, tenendo in considerazione il caso tedesco e la giurisprudenza cedu in materia.
