The study critically analyzes Legislative Decree n° 507 of 30 December 1999, implementing Law n° 205 of 25 June 1999, reforming the system of penalties for the issuing of unauthorised or uncovered bank and postal cheques. This reform, which responds to the need to enhance protection for the circulation of cheques, introduced an alternative system of penalties to the penal system; its effectiveness is based on the fact that all agents have access to information on people who have used cheques in an illicit manner and that prohibitive measures are applied to those responsible for such behaviour. For the purpose of implementing the innovations introduced, these new rules have provided for the setting up at the Bank of Italy of a computerised archive of bank and postal cheques and payment cards (called Centrale di Allarme Interbancaria – CAI).
Il volume analizza criticamente e offre un panorama ragionato della disciplina normativa relativa alla cosiddetta Centrale d’Allarme Interbancaria (CAI), come nel gergo della prassi bancaria viene chiamato il sistema di centralizzazione delle informazioni sui rischi di pagamento mediante assegno ovvero carte di pagamento. Tale sistema prevede l’iscrizione nell’archivio informatizzato, denominato appunto Centrale d’Allarme Interbancaria, dei dati personali relativi ai soggetti che hanno illecitamente emesso assegni senza autorizzazione ovvero senza provvista, nonché dei soggetti cui sia stata revocata l’autorizzazione all’utilizzo di carte di pagamento e dei dati relativi agli assegni e alle carte di pagamento revocati, sottratti o smarriti. Dall’iscrizione conseguente ad illecita emissione di assegni deriva l’effetto automatico della cosiddetta revoca di sistema all’utilizzo dello strumento dell’assegno, per un periodo determinato. Il volume delinea quindi il regime di responsabilità nel caso di illecita iscrizione nella Centrale, nonchè i caratteri della tutela cautelare azionabile dal cliente bancario.
