The article deals with the OMT decision of the Bundesverfassungsgericht and analyses the impact of this case law on the EU institutional system. This is the first prliminary ruling of the BVerfG and deepens the theory of the control on the potentially ultra vires act.
Il lavoro tratta la sentenza OMT del BVerfG e analizza l'impatto di questa decisione sugli assetti istituzionali dell'UE. E' il primo caso in cui il BVerfG ha sollevato un rinvio pregiudiziale dinanzi alla CGUE e in esso viene ulteriormente precisata la teoria del controllo sugli atti potenzialmente ultra vires.
