Le finzioni giuridiche nel diritto costituzionale

The book analyzes the peculiar connotations of legal fictions in public law and, particularly, in constitutional law. In the investigation of differences and similarities with other instruments of the legal technique, the bond that legal fictions have with legal reality and material reality is largely emphasized. The positions of the scholarship on the scope of legal fiction in contemporary law are read in the light of the material interests and the goals of transformation or conservation hidden behind this instrument.

Il volume analizza le peculiari connotazioni delle finzioni giuridiche nell'ambito del diritto pubblico e, in particolare, del diritto costituzionale. Si individuano differenze e analogie con altri strumenti della tecnica giuridica e si sottolinea il legame che le finzioni giuridiche intessono con la realtà giuridica e la realtà materiale. Le posizioni della dottrina sullo spazio della fictio iuris nel diritto contemporaneo sono lette alla luce degli interessi materiali e degli obiettivi di trasformazione o conservazione che dietro tale strumento si nascondono.
