Sfera pubblica e Costituzione europea

This intervention illustrates some of the most significant contributions to the wide ongoing debate on whether or not a European Constitution - and on any forms it should take - in particular, the need, widely felt, that in Europe the ' Constitutional processing can no longer whether participating more and more careful and aware of public opinion. If for some a Constitution of the Union will not give until it will form a European people, for others - and this is the position here that you want to support - rather than the mere resultant linear it could, on the contrary, constitute the basis and the formative factor of the same European people. The process of constitutionalization of Europe no longer be thought of in dependence on the classical model giuspubblicistico continental, focusing on the triad Sovereignty-People-Constitution but, on the contrary, in close interdependence with the dynamics of the formation of a public sphere in a position to progressively interact between their cultural differences that constitutes the identity of Europe.

Il presente intervento illustra alcuni tra i contributi più significativi all’ampio dibattito in corso sulla necessità o meno di una Costituzione europea - nonché sulle eventuali forme che essa dovrebbe assumere – in particolare riferimento all’esigenza, ampiamente avvertita, secondo cui in Europa l’elaborazione costituzionale non possa più prescindere dalla partecipazione sempre più attenta e consapevole dell’opinione pubblica. Se per alcuni una Costituzione dell’Unione non potrà darsi fino a quando non sarà formato un popolo europeo, per altri – ed è questa la posizione che qui si vuole sostenere – piuttosto che la mera risultante lineare essa potrebbe, al contrario, costituire il presupposto e il fattore formativo dello stesso popolo europeo. Il processo di costituzionalizzazione dell’Europa va pensato non più in dipendenza dal classico modello giuspubblicistico continentale, imperniato sulla triade Sovranità-Costituzione-Popolo ma, al contrario, in stretta interdipendenza con la dinamica di formazione di una sfera pubblica in grado di far progressivamente interagire fra loro le differenze culturali in cui consiste l’identità dell’Europa.
