The decision is particularly interesting in relation to the material element of crimes against humanity and the crime of persecution. The appeal decision focuses on the standard of proof, the difference between ordering and command responsibility (as far as the mens rea is concerned) and clearly defines for the first time the relationship between direct responsibility and accountability of the commander.

La Trial Chamber ha ritenuto l’accusato colpevole di crimini di guerra e crimini contro l’umanità. La pronuncia è particolarmente interessante in relazione all’elemento materiale dei crimini contro l’umanità e al crimine di persecuzione. La sentenza di appello si concentra sullo standard della prova, la differenza tra ordering e command responsibility (per quanto riguarda la mens rea) e definisce chiaramente per la prima volta il rapporto tra responsabilità diretta e responsabilità del comandante.
