La politica spaziale europea: una competenza dell'Unione ancora da definire

he Treaty of Lisbon has included “space” within the parallel competences of the EU (articles 4(3) and 189 of the TFUE), while other initiatives in the space field are founded on the CFSP, under the responsibility of the EU High Representative for Foreign Affairs and Security Policy (Article 2(4) of the TFEU and Title V, Articles 21-40, of the TEU). Art. 189, together with Art. 4, of the Treaty on the Functioning of the European Union (TFEU) provides for a parallel competence of the Union and its Member States. It also explicitly provides for the exclusion of national legislation harmonisation in the field of the so defined ‘space competence’. The prohibition of legal harmonisation at European level only concerns legislative actions taken on the basis of Article 189 TFEU and more precisely, the measures to be taken in the framework of the European Space Programme. Similar actions taken on the basis of other provisions of the TFEU (i.e. Internal Market, Competition, Environment) are not subject to the same restriction.

Il prodotto approfondisce il tema della competenza dell'Unione europea, a seguito dell'entrata in vigore del Trattato di Lisbona il 1 dicembre 2009, in material di politica spaziale. Esso dimostra come tale competenza non possa essere qualificata come concorrente, ma vada invece consoderata come una competenza parallela a quella degli Sati membri in pari materia. Sono delineate le oartciolarità giuridica di questo tipo d competeza accanto a quelle esclusive, condivise e di sostegno.
