The Legal Status of Lawful Combatants of the Soldiers of the Armed Forces of the Repubblica Sociale Italiana in the Light of the Military Supreme Court's Sentence n. 747of 26th April 1954

The sentence n. 747 as of April 26, 1954 of the Military Supreme Court focused on the status of the regular armed forces of the Reign of the South and of the regular armed forces of the Combatants of the Repubblica Sociale Italiana. The sentence confirmed that after the armistice the sovereignty de facto over the southern part of Italy was yielded by the occupying allied Powers. On the contrary, the same sentence stated that "it is not sufficient to invoke German methods for the purpose of concluding that they were the occupiers and, therefore, that the Italian Social Republic was not a de facto government". A deep inquiry on the lawfulness both of the South Reign Combatants and of the Combatants of the Repubblica Sociale Italian is also conducted.
