L'interpretazione del diritto nella prospettiva estetica di Luigi Pareyson

The work presented here starts from the question: does the thought of Louis Pareyson can also be considered as a work of philosophy of law? Notes with simplicity, for the student of this specific discipline, the philosophy of an author who has devoted explicit analysis speculative issues traditionally dealt with by the philosophy of law? Even through references to authors who, as pointed out by Tomatis in the preface to this work, the Parsis are more congenial for the establishment of an ideal dialogue with the thought of Pareyson, should gradually emerge, in fact, the figure of a philosopher who approached the reasons essential to an accomplished questioning about the meaning of the law, developing into fruitful directions for the interpreter. As explicitly argued here is that the question of legality can be found in the philosophy of Pareyson a deep meditation, offering lines for an understanding of the law, will be accessible through the paths of his thought, intelligible from the problems of man, that are always the problems of society which inevitably belongs. The steps that characterize the reflection on the social dimension of Pareyson converge to report that the man (the person, the individual) it guides the normative forms, receptive to a specific value. The value that the company, formed by the people who participate, it must implement mode norms, - therefore observe that legal rules - consists in the mutual recognition of the people themselves, because without their participation would undermine the training of social structure.

Il lavoro che qui si presenta muove dalla domanda: il pensiero di Luigi Pareyson può considerarsi anche come opera di Filosofia del diritto? Rileva, con essenzialità, per lo studioso di tale specifica disciplina, la filosofia di un Autore che non ha dedicato esplicite analisi speculative alle questioni tradizionalmente trattate dalla Filosofia del diritto? Anche attraverso riferimenti ad autori che, come ha ricordato Tomatis nella Prefazione a quest'opera, sono parsi i più congeniali per istituire un ideale dialogo con il pensiero di Pareyson, dovrebbe progressivamente emergere, in effetti, la figura di un filosofo che avvicina i motivi essenziali di un compiuto questionare sul senso del diritto, sviluppandosi in direzioni feconde per l’interprete. Quanto qui esplicitamente si sostiene è che la questione della giuridicità può trovare nella filosofia di Pareyson una meditazione profonda, offrendo le linee per una comprensione del diritto, da rendere accessibili attraverso i percorsi del suo pensiero, intelligibile a partire dai problemi dell’uomo, che sono anche sempre i problemi della società cui inevitabilmente appartiene. I passaggi che caratterizzano la riflessione di Pareyson sulla dimensione sociale, convergono nel comunicare che l’uomo (la persona, il singolo) ne orienta le forme normative, ricettive di un valore specifico. Il valore che la società, formata dalle persone che vi partecipano, deve recepire in modalità normative, – che pertanto rilevano come norme giuridiche – consiste nel reciproco riconoscimento delle persone stesse, poiché senza la loro partecipazione verrebbero meno le condizioni formative della struttura sociale.
