The hand-written and printed versions of the Consultations by Pardessus, the first to be professor of the Code de commerce chaire at the law school in Paris, are now kept at the library of the Cour de cassation. They offer new insights into the development of the Code de commerce and the personality of a lawyer outstanding between Delvincourt and Thaller in French commercial legal science. Although a supporter of the prevailing dominance of French culture and a fervent advocate of codified law, Pardessus fostered a strong tendency towards conceptualisation which sprang from his contacts with German legal theory. His main merit lays in the presentation of a renouved systematic working of the code whilst being aware of its limitations when compared to the Napoleonic Code. Pardessus succeeded in putting together and clarifying a hitherto untreated subject with categories, often borrowed from civil law, but at the same time paying attention to the socio-economic aspect and the growing, pressing and autonomous nature of the subject-matter. His steadfast purpose was to improve and normalise commercial law, based on an old and well established tradition, which had to be taken into consideration even though it was confronted with economic and social demands as well as with changes imposed by the revolutionary vicissitudes and by the market.
L’autore studia le "Consultazioni" edite e inedite di Jean-Marie Pardessus, primo professore di diritto commerciale nella Facoltà di Giurisprudenza di Parigi, conservate nella Biblioteca della Corte di Cassazione, che forniscono nuovi elementi per comprendere l'evoluzione del Codice di commercio e la personalità di un giurista che si impone nella dottrina commercialistica francese tra Delvincourt e Thaller. Anche se legato alla cultura dominante nel suo paese e convinto sostenitore della legge codificata, Pardessus nutre una forte tendenza alla concettualizzazione risultante dalle sue relazioni con la scienza giuridica tedesca. L’autore dimostra che il suo merito principale è stato quello di aver presentato un rinnovamento sistematico del codice, ben consapevole dei suoi limiti rispetto al Code Napoléon. Pardessus, in effetti, arriva a costruire e ad affinare una materia grezza che spesso prende in prestito le categorie del diritto civile, ma sempre tenendo in conto gli aspetti economico-sociali e la dimensione crescente, pressante e autonoma dalla materia. L’obiettivo costante del giurista è quello di migliorare la normalizzazione del diritto commerciale, basata su una tradizione antica e ben consolidata, che deve essere presa in considerazione anche in rapporto ai mutamenti che le vicende rivoluzionarie e le esigenze del mercato impongono.
