La esclavitud de las mujeres en el mundo contemporáneo: la gestación subrogada a la luz del valor de la dignidad humana.

The essay examines the issue of contemporary forms of women's exploitation, focusing in particular on surrogacy. Starting from the premise that all forms of surrogacy—whether commercial or altruistic—are incompatible with the objective value of human dignity, the Author analyses the complex legislative and judicial developments that have accompanied the prohibition of surrogacy in Italy. Particular attention is devoted to the legal status of children born abroad through surrogacy despite the domestic prohibition.

Il saggio affronta il tema delle moderne schiavitù delle donne, in particolare tra queste la maternità surrogata. Muovendo da una riflessione relativa alla incompatibilità di ogni forma di maternità surrogata, commerciale o solidale, rispetto al valore oggettivo della dignità umana, l'A. affronta la complessa vicenda legislativa e giurisprudenziale che in Italia ha accompagnato il divieto alla pratica della maternità e la definizione in particolare dello status del nato all'estero nonostante il divieto.
