After outlining the historical and legal evolution of the Social Charter following the 1996 revision, this paper focuses on the protection that this system guarantees to individuals benefiting from any form of international protection, protection that owes much to the evolving practice of the European Committee of Social Rights. On the basis of these general aspects, the article then analyses the right to health and medical care that the aforementioned category of individuals can be assured on the basis of the Charter. The next part of the work examines the interesting evolution of the relationship between the Italian legal system and the European Social Charter in the light of constitutional jurisprudence, with a view to highlighting the possible repercussions of the Committee’s jurisprudential practice on the situation in Italy of a particular heterogeneous vulnerable group: the Roma.
