Magistrati e ordinamento giudiziario negli anni della dittatura

L’articolo affronta il tema del rapporto tra magistratura e regime fascista sotto un duplice profilo: le norme dell’ordinamento giudiziario, introdotte dai diversi ministri della Giustizia che si susseguirono, e la prassi nella gestione delle carriere e della disciplina. In effetti, il controllo di questi due aspetti determinanti per il funzionamento del sistema della giustizia rimase saldamente nelle mani dell’alta magistratura in un compromesso costante con la dittatura. The article examines the relationship between the judiciary and the Fascist regime in two aspects: the laws of the judicial system, introduced by the various ministers of justice, and the practice in career management and discipline. Indeed, control of these two aspects, crucial to the functioning of the justice system, remained firmly in the hands of the high judiciary in a constant and fruitful compromise with the dictatorship.
