I proventi degli immobili urbani nella res privata: un’analisi di C.Th. 7.8.9

Among the assets that generated income, as is well known, land holdings were by far the most prevalent. However, we also have evidence of some urban properties in the possession of the imperial treasury. Of particular interest is a provision of the Theodosian Code, 7.8.9, which attests to the confiscation and exploitation of certain urban properties. This paper aims to investigate the rationale behind this provision in relation to other similar provisions, who the conductores mentioned in the provision were, and what the underlying dynamics of this locatio-conductio were.

Tra i cespiti che producevano proventi, come è noto, una prevalenza assoluta era data ai beni fondiari. Tuttavia abbiamo notizia anche di alcuni immobili urbani nella disponibilità della casse imperiali. In particolare, è meritevole di interesse una costituzione del Codice Teodosiano, la 7.8.9, che testimonia la confisca e la messa a profitto di alcune proprietà urbane. Il presente contributo vuole indagare quale fosse la ratio della norma rispetto ad altre norme analoghe, chi fossero i conductores citati nella costituzione e quale fosse la dinamica sottesa a questa locatio-conductio.
