Il Lazio pontificio. Bilancio e prospettive della ricerca sugli statuti

The text comprises a series of general considerations on the studies that have focused on the statutes of cities, lands and castles of the territories of the Church State that are currently included in the region of Lazio. It is acknowledged that these territories were not homogeneous, both in terms of their relations with the central papal power and their different municipal experiences. A limited production of statutes in the Middle Ages is characteristic of these territories, which increased significantly from the 15th century onwards and again in the modern age. The validity of these statutes for some topics continued until the annexation to the Kingdom of Italy. With regard to pontifical Latium, the existing research tools are deficient in terms of the systematic survey of the relevant statute heritage, and there is a need for critical editions in order to encourage further historical-legal studies. The necessity for a comparative approach in studies on tatutes is also argued, with the argument that such an approach must also take into account the institutional context and relations with papal legislation.

Il testo contiene alcune riflessioni generali sugli studi che nell’ultimo trentennio hanno avuto a oggetto gli statuti di città, terre e castelli di quei territori dello Stato della Chiesa attualmente ricompresi nella regione Lazio. Si tratta di territori tra loro disomogenei, sia per quanto riguarda le relazioni con il potere centrale pontificio che per le diverse esperienze comunali. Caratteristica di questi territori è una produzione statutaria limitata in epoca medievale, che conosce un significativo incremento a partire dal XV secolo e ancora in età moderna, la cui vigenza per alcune materie si è prolungata fino all’annessione al Regno d’Italia. Con riferimento al Lazio pontificio vengono messe in evidenza le lacune degli strumenti di ricerca esistenti e l’esigenza di una ricognizione sistematica del relativo patrimonio statutario, nonché l’importanza di edizioni critiche accurate per favorire ulteriori studi storico-giuridici. Viene, inoltre, sostenuta la necessità di un approccio comparativo negli studi sugli statuti, che devono altresì tenere conto del contesto istituzionale e dei rapporti con la legislazione pontificia.
