The chapter aims to explore the issue of the recognition of a child born abroad through surrogacy, despite the prohibition against this practice by Italian law. In particular, an attempt is made to understand the role of the Italian judges, the Constitutional Court and the European Court of Human Rights in this regard, while there is also an exploration of the national policymaker’s role in defining this delicate issue that requires a balance between the ‘best interest of the child’ and the ban on surrogacy in Italy. Over the years, in fact, the complex interweaving of the jurisprudence of the Constitutional Court in dialogue with the European Court of Human Rights, has resulted in a sufficiently articulated and broad framework of protections that today leads to questions about the residual extent of legislative discretion.
Il capitolo si propone di affrontare la questione del riconoscimento di un bambino nato all'estero attraverso la maternità surrogata, nonostante il divieto di questa pratica da parte della legge italiana. In particolare, si tenta di comprendere il ruolo dei giudici, della Corte Costituzionale e della Corte Europea dei Diritti dell'Uomo tenendo conto al tempo stesso del ruolo del legislatore nazionale rispetto a una questione delicata e complessa che richiede di operare un bilanciamento tra “il miglior interesse del bambino” e il divieto di maternità surrogata in Italia. Nel corso degli anni, infatti, il complesso intreccio tra la giurisprudenza della Corte Costituzionale e quella della Corte Europea in dialogo con la Corte Europea dei Diritti dell'Uomo, ha portato alla definizione di un quadro di tutele sufficientemente articolato che oggi induce però a interrogarsi sull'ampiezza residua della discrezionalità legislativa.
