Reflexões sobre a essencialidade da democracia no direito sindical brasileiro e contraponto no ordenamento jurídico italiano

The purpose of this article is to present a synthetic picture of the role of democracy in Brazilian trade union law. To this end, initial ideas were presented on the concept of democracy itself, its constitutional basis and its intersection with social rights, especially those specific to labor law and relating to the role of unions. It was also possible to discuss the internal and external aspects of democracy in trade unions. In addition, an analysis was proposed of controversial issues such as union freedom and union uniqueness, as well as compulsory financing by workers. To give the reader a broader view of the subject, a correlation was made with democracy in Italian trade union law. In turn, the article concludes that trade unions, even those based on democratic principles, need to adapt to the new digital society that is emerging and rapidly changing social relations.
