The aim of this work is the reconstruction of Mortati’s theoretical path through the study of some essential pages of his works during the period in which he was professor and rector at the University of Macerata. We will revisit some significant sections of Costantino Mortati’s work from that period to highlight his essential contribution to the science and methodology of public law. In many ways, the cornerstone of his legal theory is the theme of the relationship between the people and power.
