Ruolo della seconda Camera e rapporti tra Stato e Regioni. Una questione ancora aperta?

On the basis of a reconstruction that is as exhaustive as possible of Beniamino Caravita's extensive scholarly production on the subject of second chambers and bicameralism in the Italian context, the author addresses the question of whether the transformation of the Senate in a territorial sense is still open in today's context. The issue arises precisely in the light of the numerous attempts that have never been made to transform the second Chamber into a Chamber of the Regions or of territorial representation and in particular after the latest failure following the negative outcome of the constitutional referendum on the draft Renzi-Boschi Reform in 2016. This was followed, as is well known, by a reform that led in 2020 to a reduction in the number of MPs and the equalisation of the electorate in the two parliamentary branches with the intention of reducing the few differences that still characterise them. In this context, however, the need to represent territorial pluralism at the heart of the institutional system and the question of what is the optimal seat for such representation still remains open.

Partendo da una ricostruzione per quanto possibile esaustiva dell’ampia produzione scientifica di Beniamino Caravita in tema di seconde Camera e di bicameralismo nel contesto italiano l’A. si interroga in relazione alla questione se la trasformazione del Senato in senso territoriale sia ancora aperta nel contesto odierno. Il tema si pone proprio alla luce dei numerosi tentativi mai realizzati di trasformare la seconda Camera in un Camera delle Regioni o di rappresentanza territoriale e in particolare dopo l’ultimo fallimento a seguito dell’esito negativo del referendum costituzionale sul progetto di Riforma Renzi-Boschi nel 2016. A questo è seguito come è noto una riforma che ha condotto nel 2020 alla riduzione del numero dei parlamentari e all’equiparazione dell’elettorato attivo nei due rami parlamentari con l’intento di ridurre le poche differenze che ancora le connotano. In questo contesto rimane però ancora aperta l’esigenza di una rappresentanza al centro del pluralismo territoriale e aperta la questione di quale sia la sede ottimale di tale rappresentanza.
