Janus-like antitrust policy: How to make the pro-FDI orientation prevail

The chapter begins with a section that briefly reviews extant literature to highlight the theorizing and empirical evidence on the two ‘faces’ of AP. It ends by offering evidence on recent economic and national 2 policy trends that make it particularly compelling to embrace the proactive side of FDI attraction so as to counter the prospect of de-growth and instability in the world economy. The following sections are devoted to suggesting reforms in the antitrust framework and policies with beneficial effects on the intensification and balanced cross-country distribution of FDI. Each section is devoted to specific key topics: (i) antitrust authority and law enforcement, (ii) AP coordination with other national regulatory policies, (iii) AP interplay with national and international economic policies.
