The lack of jurisdiction over electoral controversies by either ordinary and constitutional courts in Italy is at the root of many constitutional problems. The author detects and examines the reasons for an area of the legal order to be deserted by the rule of law as political parties in many ways seem no to be subjected to the law as compared to other subjects. The creation of a jurisdiction on this kind of controversies would solve many constitutional problems and help political parties to recreate a legitimacy they seem to have lost
