The analysis deals with an original attempt in order to relate the Hartian idea of Rule of recognition with an original configuration of the traditional concept of material constitution. If the material constitution could be considered as the supreme source of a legal system it depends on the foundations of the Law within that political system. Reflecting on the opposite views of the Constitution in a descriptive and/or prescriptive, normative meaning, the authors conclude that the formal constitution entrenches the material.
