In environmental matters, certain deficiencies in the traditional penal system appear especially evident, both in relation to the victims and the offenders. This paper analyzes the possible responses from Restorative Justice to meet the requirements of the constitutional protection of the environment in the Italian legal system, from the perspective of general and special criminal law.
