Economia de compartilhamento e inovações laborais: os limites e intersecções dos trabalhos de crowdwork e o direito do contratante sob a perspectiva juslaboral e do direito autoral

The object of the study is the sharing economy and the new tools of socioemployment relationship, in particular the work under the crowdwork platform. The methodology chosen for the elaboration of the work was the inductive-bibliographical- documentary one. The advent of new information and communication technologies facilitated social interaction, especially that managed remotely, without the need for a direct approach to the interlocutors or traditional face-to-face communication. Faced with this, new work modalities were also, and are being, constituted, such as crowdwork, which still lacks regulation and, as a result, is governed by avid capitalism and market liberalism. The problem that overlaps with the absence of specific regulation is in the relationship between the parties, in the case of contractor and crowdworking, and the original rights and duties. Traditional labor legislation was not established to regulate relationships without any of the essential requirements for the employment relationship, in particular legal subordination, as occurs in the relationship between crowdwork and contractor. The inquiry also enters the field of right over creation, considering that there is still no clear outcome on who will be the holder of rights in relation to the work generated in this relationship, even if the contracting has been carried out by third parties.
