Over time, there were specific moments in which paradigms were broken and new realities were imposed. This began to happen faster and faster, and it is credible to say that, in recent times, the world has experienced profound changes in various fields, such as science, economics, politics and, especially, technology. The popularization of personal computers and smartphones, the improvement of software and the development of means of communication, which took place especially in the last decade, has had an impact and is having a very significant impact on the way in which work is carried out. In the pre-pandemic period, this movement was already evident, with many companies migrating their systems and processes to what is called the “cloud”, that is, collaborative digital environments and accessible via the Internet, enabling the adoption of means of work away from the establishment. business. In Brazil, the Consolidation of Labor Laws - CLT, in an amendment promoted in 2011 by Law No. 12,551, started to protect, even if superficially, this theme. Subsequently, the 2017 Labor Reform (Law No. 13,467) advanced a little further in this sphere, detailing some topics that lacked regulation at that time, such as the inclusion of art. 75-A and following in the consolidated text. However, effectively the pandemic boosted the implementation of remote work, since under the justification of public health protection, the whole world was closed in their homes and work began to be carried out in this new format. Many companies even disclosed, during the atypical year of 2020, that they were planning to definitively abandon in-person work in the post-pandemic in view of the success of this new way of work. The worst moment of the pandemic has already been overcome, in early 2022 Provisional Measure No. 1,108/2022 was edited, which allowed the adoption of remote work even for interns and apprentices. Thus, it is in this context that the present article intends to focus, studying the reasons that supported the evolution of remote work and the impacts caused by its adoption in the professional and personal life of the worker, confronting this new scenario with the right to improve the social condition. of the worker, a premise set out in the caput of art. 7 of the Federal Constitution.
