Considering the increase in the use of remote work, due to the COVID pandemic, this study seeks analyzing the normative evolution of this type of work in Brazil and Italy, specifically analyzing issues related to the safety and health of employees. As this situation is replicated in several countries, the comparative analysis of two different legal systems aims to establish common points and highlight the differences on the subject, considering the historical evolution and the economic and social position of each one, to identify possible exchanges and legislative improvements. About the methodological aspects, this paper will be prepared by legislative and bibliographic review of Brazil and Italy, using qualitative criteria. This research shows that there are similarities between these legal systems. This is because, in some modalities of remote work, the rules relating to health and safety are not very specific, and it is up to the social actors to resort to interpretation or recommendation of a non-normative nature.
