Trasformazioni costituzionali nell’allargamento dell’Unione europea

The European constitutional order is based on the common values that emerge from the constant dialectic between the Union and the Member States. Values that come from the common constitutional traditions of the Member States and that fall upon them in a new and more effective guise. States wishing to join the European Union must first and foremost prove that they have adhered to these values, bringing their own legal system into line with them. Accession thus becomes a constitutional momentum for all parties involved: the Union, the Member States and the acceding states. They are all protagonists in a process of continuous integration - political and legal - that is the real driving force behind the European federalisation process.

L’ordinamento costituzionale europeo si fonda sui valori comuni che emergono dalla costante dialettica tra Unione e Stati membri. Valori che provengono dalle tradizioni costituzionali comuni degli Stati membri e che su di essi ricadono sotto una nuova e più efficace veste. Gli Stati che intendono entrare a far parte dell’Unione europea devono dimostrare innanzitutto di aver aderito a questi valori, conformando ad essi il proprio ordinamento. L’adesione diventa così un constitutional momentum per tutte le parti coinvolte: l’Unione, gli Stati membri e gli Stati aderenti. Tutti protagonisti di un processo di integrazione continua –politica e giuridica – che è il vero motore del federalizing process europeo.
