The standardization, de jure as well as de facto, gives rise to critical issues also in the field of antitrust law. Especially in recent years, the European case law and that of some member states have in particular dealt with the violation of the so-called FRAND commitments, which are undertaken by the holders of those patents that become essential for the implementation of the selected standard (Standard Essential Patents - SEPs). The EU Commission and the Courts have then several times applied the provisions on abuse of a dominant position to the attempt of the SEPs holders to prevent access to these patents by subjects that need them to operate in the downstream markets. The essay traces the development of European law dealing with the refusal to deal, identifying similarities and differences with the issues currently on the agenda in relation to refusal of SEPs, and expresses some doubts about the systematic coherence of the solutions adopted.

La estandarización, de jure y de facto, da lugar a problemas en el campo del derecho de la competencia. Especialmente en los últimos años, la jurisprudencia europea y la de algunos Estados miembros en particular han tratado la violación de los llamados compromisos razonables y no discriminatorios, que se llevan a cabo por los titulares de las patentes que se convierten en esenciales para la aplicación de la norma seleccionada (Standard Essential Patents - SEP). La Comisión de la UE y los tribunales han entonces varias veces aplicado las disposiciones sobre el abuso de posición dominante a los titulares de SEPs que intentan evitar el acceso a estas patentes por los sujetos que las necesitan para operar en los mercados descendentes. El ensayo traza el desarrollo del Derecho Europeo frente a la negativa a tratar, la identificación de similitudes y diferencias con las cuestiones actualmente en el orden del día en relación con la negativa de las SEPs, y expresa algunas dudas sobre la coherencia sistemática de las soluciones adoptadas.
