The author discusses the democratic deficit theory concerning the Community and its institutions, trying to construct a theory of a Community rule of law as based on: 1) the national parliaments consensus to the treaties as a base to Community legislation; 2) the increasing role of the European Parliament in EU legislation; 3) the bad level of democratic accountability of internal political institutions.
