The contribution investigates who can invoke the invalidity of treaties in cases of so-called "absolute" invalidity, like the contrast with a peremptory norm or a treaty concluded because of threat or use of force, and what are the consequences of such invalidity for States not party to the treaty. It concludes that practice, supported by theoretical bases, points to non-recognition of the effects of the treaties.
