O direito fundamental ao trabalho sob a perspectiva das pessoas com deficiência

On the assumption that work is a fundamental right, necessary for the consolidation of human dignity, by the vision of the Universal Declaration of Human Rights and the Constitution of the Federative Republic of Brazil of 1988, in addition to the protective norms described in the Statute of the Person with Disabilities and Law 8.213/91 in the processes of inclusion of this population in the labor market, it is questioned whether in the Municipality of Curitiba and Metropolitan Region the Brazilian legislation is effective, by the perspective of disabled people in the inclusion and permanence in the labor market, being this the general objective of the present dissertation. The analysis of the historical social evolution of people with disabilities, as well as the study of international and national legislation of the labour law, are issues analyzed in this dissertation. Furthermore, considering the object of the present study, it was necessary to verify the percentage of employability, and the barriers in the light of the perception of the person with disability for their inclusion and maintenance in the labor market in Curitiba and in the Metropolitan Region. The qualitative, critical and interdisciplinary approach was used in order to perceive the existence or not of barriers to inclusion of people with disabilities in the labor market. As for the research objectives, it is a descriptive research, whose purpose is to analyze, observe, record and correlate aspects (variables) that involve facts, without manipulating them. As for the technical procedures, a bibliographic survey was initially made at a State of Art level to identify what experts published about the subject. After the bibliographical survey, and considering the general objective of the present study, a field study was conducted, which seeks to deepen a specific reality. In the present case, interviews were conducted with people with disabilities, so that their perception indicated the existence or not of barriers to access and stay on the labor market. The research was carried out through a semi-structured questionnaire, which was transcribed and organized into forms, that generated the tables and graphs that were analyzed from a critical perspective. The results expose, from the perspective of the disabled person, both the difficulty to maintain employment and access to the labor market.
