LA GESTIONE INFEDELE DI PORTAFOGLI DI INVESTIMENTO DOPO IL RECEPIMENTO DELLA DIRETTIVA MIFID

The need for investor protection and greater market efficiency have prompted the legislature to reform several times in recent years, the discipline of the financial system. Among the numerous repeated interventions, stands the Legislative Decree no. September 17, 2007, n. 164 and - at the level of secondary legislation - the new Regulations related Intermediaries and Markets and Regulation joint Consob-Bank of Italy. Through these measures have been implemented, in particular, the directive "Markets in Financial Instruments Directive" (MiFID cd) and, therefore, to choices made by the EU to ensure the development of European financial markets and make them competitive with the strongest markets overseas. The work, in particular, discusses the news of the MiFID in relation to management of investment portfolios unfaithful.

Le esigenze di tutela dei risparmiatori e di una maggiore efficienza dei mercati hanno spinto il legislatore a riformare più volte, in questi ultimi anni, la disciplina dell’ordinamento finanziario. Tra i ripetuti e numerosi interventi, spicca il D.Lgs. 17 settembre 2007, n. 164 e – sul piano della normativa secondaria – i collegati nuovi Regolamenti Intermediari e Mercati e il Regolamento congiunto CONSOB-Banca d’Italia. Attraverso questi provvedimenti si è data attuazione, in particolare, alla direttiva “Markets in Financial Instruments Directive” (c.d. MIFID) e, quindi, a scelte maturate in sede comunitaria per garantire lo sviluppo dei mercati finanziari europei e renderli competitivi con i più forti mercati d’oltreoceano. Il lavoro, in particolare, approfondisce le novità della MIFID in tema di gestione infedele di portafogli di investimento.
