This essay examines the main issues that have covered the first ten years of implementation of Law no. 241 of 1990 with particular reference to participation of the public in administrative procedures. Taking into account both the case law and the doctrine, the paper, in a first stage, analyzes the tools provided for by Law no. 241 of 1990 with regard to the obligation of communication to the persons entitled to participate, the right of information and the assessment obligation, and thereafter performs broader considerations about the nature of the participatory model that is emerging from the first decades of application and the impact that it has on the legitimacy of the case. A picture of light and shadows emerges from the first application of the law which, although it still manifests a significant distance between the objectives of the 1990 reform and its implementation, however, marks significant changes in the relationship between public administration and citizens.
Il saggio affronta i principali nodi che hanno riguardato i primi dieci di anni di applicazione della legge n. 241 del 1990 con particolare riferimento alla partecipazione al procedimento amministrativo. Tenendo conto degli orientamenti dottrinali ma soprattutto di quelli giurisprudenziali, il saggio, in una prima fase, analizza gli istituti previsti dalla legge n. 241 del 1990 con riferimento all'obbligo di comunicazione, ai soggetti legittimati a partecipare, al diritto di accesso e all'obbligo di valutazione; successivamente svolge considerazioni più ampie sulla natura del modello partecipativo che si delinea dalla prima applicazione decennale e sui riflessi che esso ha sulla legittimazione processuale. Emerge così un quadro di chiari e ombre sulla prima applicazione della legge che, sebbene manifesti una distanza ancora significativa tra obiettivi della riforma del 1990 e sua realizzazione, segna comunque novità significative nei rapporti tra pubblica amministrazione e cittadini che non devono essere sottovalutate.
