The objective of this work is to analyze the importance and fundamentality of Labor Law in the era of the new technological revolution, as well as the paths and challenges faced in the 21st century capitalist society with regard to the world of work. The historical importance is portrayed in the paradigm shift currently experienced in capitalism, promoted by the use of the internet and microinformatics, in the context of the Fourth Technological Revolution, whose repercussions have reflected in profound changes in the organization of work. The high rates of unemployment, partly due to the automation and robotization of work, led to a forced migration of workers towards “entrepreneurship” through the use of digital platforms that, at times, masked an effective employment relationship. The migration from formal employment to work coordinated by digital platforms has become the subject of constant debates 6 promoted academically and submitted to the Judiciary, whose exact scope and repercussions have not yet been fully defined. The “uberization” of work, a nomenclature used to describe the work relationships that emerged with the Fourth Technological Revolution mediated by digital platforms, translates into a phenomenon whose social repercussion is current and evident, both at the international level and at the domestic level . This scenario of insecurity reveals the need for further study of the social repercussions on the subject in order to avoid abuse in the exploitation of human work. The premise that the use of technologies, said to be disruptive, has the sole purpose of connecting providers to service providers should be viewed with caution, so that human labor is not treated as a commodity. In this light, it is important to re-read the concept of subordination in the face of this new model of labor organization to combat the exploitation of work intermediated by the use of digital platforms, in order to put into practice what the Constitution outlined as a basis social order and social welfare and justice as an objective.
