La capacità giuridica del puer tra ius divinum e ius humanum. Il diritto romano arcaico

In ancient legal lexicon, puer means a group of people who are in the same age range, no matter their gender or their family ties, instead of what happens for the terms filius and filia. Ius sacrum and some of the leges reges recognize them rights. This confirms the hypothesis that familia proprio iure, that is based on patria potestas, at the time wasn’t the backbone of the society, not having gained the same importance that is going to reach afterwards.

Nel lessico giuridico arcaico puer designa un gruppo di soggetti individuati in base all’età e indipendentemente dal sesso e dai legami di parentela familiare, come accade invece per filius e filia. La capacità giuridica riconosciuta al puer dalle norme dello ius sacrum e da alcune leggi regie sembra confermare l’ipotesi avanzata su altre basi della dottrina, secondo cui nella Roma delle origini la familia proprio iure, caratterizzata dalla soggezione di tutti i suoi componenti al potere assorbente del pater, la patria potestas, non avesse ancora assunto il carattere di struttura fondante della comunità giuridica.
