Il bicameralismo incompiuto. Democrazia e rappresentanza del pluralismo territoriale in Italia

Starting from the analysis of the current democratic crisis, the research questions the methods of revitalizing democracy and Parliament in Italy. In a pluralistic and polycentric context, which has always been crossed by numerous cleavages, above all territorial ones, it is clear that it is impossible to ignore the presence at the "center" of the territorial realities. First of all the presence of the Regions that the Constituent Assembly itself had conceived as instruments that would have contributed to the democratization of the system. Today, however, it is inevitable that Italian regionalism still remains, in many ways, ambiguous and uncertain. Furthermore, it is necessary to take into account the difficulty, mainly political, of transforming the current anomalous symmetrical bicameralism into one of an asymmetrical type, with the introduction of a Senate expressing territorial autonomies. After addressing numerous theoretical issues, connected to democracy and representation, sovereignty and subsidiarity, the volume tries to demonstrate how the difficulties and shortcomings that are found certainly do not cast doubt - indeed, rather, reinforce - the need to ensure the link between the center and the periphery and to identify, therefore, the most suitable tools today to achieve the necessary "loyal cooperation" between territories within the current decentralized reality.

Muovendo dall’analisi dell’attuale crisi democratica, lo studio si interroga sulle modalità di rivitalizzazione della democrazia e del Parlamento in Italia. In un contesto pluralistico e policentrico, da sempre attraversato da numerosi cleavage, soprattutto territoriali, appare evidente infatti come sia impossibile prescindere dalla presenza al “centro” delle realtà territoriali, in primo luogo delle Regioni, concepite peraltro dallo stesso Costituente quali strumenti che avrebbero dovuto contribuire alla democratizzazione del sistema. Oggi tuttavia, è inevitabile constatare che il regionalismo italiano rimane ancora, per molti versi, ambiguo ed incerto. Inoltre non si può non registrare la difficoltà, principalmente politica, di realizzare la trasformazione dell’attuale anomalo bicameralismo simmetrico in uno di tipo asimmetrico, con l’introduzione di un Senato espressivo delle autonomie territoriali. Dopo aver affrontato numerose questioni teoriche, collegate alla democrazia e alla rappresentanza, alla sovranità e alla sussidiarietà, il volume cerca di dimostrare come le difficoltà e le carenze che si riscontrano non mettano certo in dubbio – anzi, piuttosto, rafforzino – l’esigenza di assicurare il raccordo tra centro e periferia e di individuare, quindi, gli strumenti oggi maggiormente idonei a realizzare la necessaria “leale cooperazione” tra territori nell’ambito dell’attuale realtà decentrata.
