L'immigrazione e il vincolo liberale. Verso un'ecologia integrale

Summary. The article briefly illustrates some essential limits that immigration Stat are bound to observe even as they claim domestic jurisdiction in the matter of expulsion of persons from their territory. These limits, in further compliance with any international commitments made by the State, can be traced back to three fundamental aspects: the prohibition of torture or inhuman and degrading treatment (Article 3 of the European Convention for the Protection of Human Rights ), the protection of vulnerable persons and respect for private and family life (art. 8 of the ECHR). These three aspects of human ecology underline the hypothesis that to be a lawfully resident alien it is not enough to have been officially admitted into the territory of the State, just as much as they do highlight the impossibility of putting forward in absolute terms the reasons for the persistence of irregular immigration.
